Recreational Use Statute: Title 4, Chapter 75S 75.001

Recreational Use Provisions: Standard, but specific liability insurance amounts are required, if not, landowner cannot limit liability under this statute. Recreational Use Statute does not cover bad faith acts by owners; insurance required = $500,000/person, $1 million/occurrence for injury or death and $100,000/occurrence for property damage.

Will a fee destroy protection: Yes if charges exceed 20 times property tax of prior year

Effects of government involvement, government lessor/owner of land: State owned, operated or maintained land has the same protection, but requires specific usage. Charge restriction may not apply to government owned or leased lands – consult a local attorney.
